NOTICE OF ARBITRATION. THIS AGREEMENT CONTAINS AN ARBITRATION PROVISION AND CLASS ACTION WAIVER THAT APPLIES TO ALL CLAIMS EXCEPT FOR CLAIMS OF INTELLECTUAL PROPERTY INFRINGEMENT OR THOSE THAT CAN BE BROUGHT IN SMALL CLAIMS COURT. EXCEPT AS OTHERWISE STATED UNDER THE TERMS OF THIS AGREEMENT, YOU AGREE THAT ANY AND ALL DISPUTES BETWEEN YOU AND MODERN BLAZE WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION, AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS, CONSOLIDATED, REPRESENTATIVE, COLLECTIVE, OR PRIVATE ATTORNEY GENERAL ACTION OR ARBITRATION.

1. User Eligibility

The Website is open to those who are age eighteen (18) or above. By using the Website, you warrant that you are at least 18 years of age, are of sound mind, and have the capacity to agree to and uphold the terms and conditions of this Agreement. If you use the Website on behalf of a business entity or other third party, you warrant that you have the authority to act as an agent of that entity and to agree to this Agreement on their behalf.

The Website and its associated trademarks and content are owned and used by Modern Blaze, including, but not limited to, Modern Blaze's trademarks: MODERN BLAZE ™ and ®. Any use of the Website, its trademarks, or its content without the prior written approval of Modern Blaze is prohibited. The selection, arrangement, and layout of the Website is the sole and exclusive property of Modern Blaze, and any unauthorized copying, public display, distribution, or derivation, whether in whole or in part, is expressly prohibited.

3. User Generated Content

Modern Blaze may provide you with the ability to upload or contribute user-generated content including product reviews ("User Feedback") and other submissions ("User Comments") (collectively "User-Generated Content"). You warrant that your User-Generated Content will not violate any law, violate any term of this Agreement, or violate the rights of third parties.

By submitting User-Generated Content to Modern Blaze, you grant us a non-exclusive, irrevocable, royalty-free, worldwide, and perpetual license to use your User-Generated Content for the customary and intended purposes of the Services. Modern Blaze assumes no responsibility for User-Generated Content submitted by users.

4. Acceptable Use Policy

When you use the Website, you agree to use it only for its customary and intended purposes and as permitted by this Agreement and applicable law. You are expressly prohibited from using the Website to:

Violate any law, statute, ordinance, regulation, or treaty
Violate the rights of a third party, including intellectual property, privacy, or publicity rights

Circumvent the technological protection measures of the Website

5. Pricing and Product Availability

Certain products or services may be available exclusively online through the Website and may have limited quantities. We have made every effort to display as accurately as possible the colors and images of our products, but we cannot guarantee that your computer monitor's display of any color will be accurate. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of Modern Blaze. We reserve the right to discontinue any product at any time.

6. Ordering and Payment

Payment for all orders placed through the Website must be made at the time of ordering. You understand and agree that the prices quoted on the Website are an invitation to deal and that no contract will be formed between you and Modern Blaze until Modern Blaze accepts your invitation to deal by performance, specifically by shipping the ordered goods. Pricing errors will not constitute a contract between you and Modern Blaze.

All costs and fees are quoted and payable in United States Dollars. Modern Blaze is not responsible for any foreign transaction fees or other fees charged by your financial institution. You agree that you will not initiate any chargebacks to Modern Blaze unless otherwise authorized by Modern Blaze in writing, and that you will be responsible for any costs associated with unauthorized chargebacks.

7. Financing Options

Modern Blaze offers financing through the following third-party providers:

Klarna — Buy now, pay later options including Pay in 4 and longer-term financing plans
Affirm — Flexible monthly payment plans with fixed terms and transparent pricing
Shop Pay Installments — Interest-free pay-in-4 and monthly installment options powered by Affirm through Shopify

More information about financing options can be found on our Financing page. All financing is subject to approval and governed by the terms and conditions of the respective third-party provider. Modern Blaze is not a party to any financing agreements between you and these providers.

8. Taxes

You agree to pay all taxes assessed by any governmental body associated with your use of and/or purchase of goods through the Website. Modern Blaze currently collects sales tax only from customers located in the state of Florida. Customers located in other states are responsible for self-reporting and remitting applicable use taxes to their state or local tax authorities. Modern Blaze will report as income all payments received from you to all proper taxing authorities.

9. Shipping

Modern Blaze provides free shipping to the contiguous 48 states and the District of Columbia for most products. Shipping to Canada and other locations outside the contiguous United States is available at additional cost, calculated at checkout. International customers are responsible for any taxes, customs fees, or duties associated with their purchase. 10. Refunds and Exchanges

Modern Blaze accepts returns and offers refunds and exchanges on most qualifying products within 30 days of delivery. For more details on returns, exchanges, and refunds, please visit our Return Policy, which is hereby incorporated into this Agreement in full. Modern Blaze strives to honor all qualifying return and exchange requests, but it reserves the right to reject such claims on a case-by-case basis and in its absolute discretion.

11. Extended Warranty

Modern Blaze offers optional extended warranty coverage on select products through Extend, a third-party warranty provider. Extended warranty plans are separate from and in addition to any manufacturer's warranty that may accompany a product. Extended warranty coverage is governed by Extend's own terms and conditions, which will be provided at the time of purchase. Modern Blaze is not a party to any warranty agreements between you and Extend.

12. Affiliate Program

Modern Blaze operates an affiliate program through which third parties may earn commissions for referring customers to our Website. Participation in the affiliate program is subject to separate Affiliate Program Terms and Conditions, available at modernblaze.com/pages/affiliate-prog r am. Modern Blaze is not responsible for representations or claims made by affiliates that are not expressly authorized by Modern Blaze.

13. SMS Service

Modern Blaze offers a mobile message service (the "SMS Service"). By consenting to Modern Blaze's SMS Service, you agree to receive recurring SMS/text messages from and on behalf of Modern Blaze through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology.

14. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store, and to promptly update your account information including your email address and credit card details as needed.

The Website may contain links to third-party websites or provide access to third-party tools over which we have no control. MODERN BLAZE OFFERS MANUFACTURER'S WARRANTIES ON MANY OF ITS PRODUCTS. MORE DETAILS REGARDING WARRANTY COVERAGE CAN BE FOUND ON THE INDIVIDUAL PRODUCT'S WEBPAGE AND WITHIN THE OWNER'S MANUAL FOR QUALIFYING PRODUCTS. MODERN BLAZE DOES NOT OFFER MANUFACTURER'S WARRANTIES ON ACCESSORIES OR PARTS.

21. Indemnification

You agree to indemnify, defend, and hold harmless Modern Blaze, its officers, shareholders, directors, employees, subsidiaries, affiliates, and representatives from any and all losses, including costs and attorneys' fees, arising out of or related to (i) your use of the Website; (ii) your purchase of products through the Website; (iii) your use or misuse of products obtained through the Website; (iv) your violation of any term or condition of this Agreement; (v) your violation of the rights of third parties; and (vi) your violation of any applicable law or regulation.

22. Choice of Law and Arbitration

You and Modern Blaze agree that any dispute arising out of or related to this Agreement or your use of the Website will be governed by the laws of the State of Florida, without regard to its conflict of laws rules.

Except for claims that may be brought in small claims court or claims of intellectual property infringement, you and Modern Blaze agree that any dispute will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its then-current Commercial Arbitration Rules, by one arbitrator appointed in accordance with such rules, in Miami, Florida, or at the option of the party seeking relief, by telephone, online, or via written submissions.

ANY DISPUTE RESOLUTION PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND MODERN BLAZE EXPRESSLY AGREE THAT CLASS ACTION PROCEDURES SHALL NOT APPLY TO ANY ARBITRATION PURSUANT TO THESE TERMS. Any claims must be brought within one year of the applicable purchase or will otherwise be barred.

23. Force Majeure

Modern Blaze will not be responsible for any delay or failure in performance arising out of any cause beyond Modern Blaze's reasonable control, such as acts of God, war, riots, fire, terrorist attacks, pandemics, power outages, severe weather, or other accidents.

24. Severability

In the event that any provision of this Agreement is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from this Agreement. Such determination shall not affect the validity and enforceability of any other remaining provisions.

25. Termination

These Terms of Service are effective unless and until terminated by either you or us. You may terminate this Agreement at any time by notifying us that you no longer wish to use our Services or when you cease using our site. If in our sole judgment you fail to comply with any term or provision of these Terms of Service, we may terminate this Agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination.
